Terms of Service – GigConnect™ & TMEOS

Third-Party Service Providers

By using GigConnect™, you also agree to the terms and policies of our essential service providers:

• Stripe (payment processing): Your use of payment features is subject to Stripe's Terms of Service and Stripe's Privacy Policy
• Base44 (infrastructure): Your data is stored and processed using Base44's platform services

These third parties have their own terms and policies. By using GigConnect™, you acknowledge and accept their terms as well.

1. Overview

GigConnect™ is a multi-sided platform that connects musicians, fans, and venues. We provide tools for event discovery, artist interaction, fan engagement, venue analytics, and subscriber-based services.

TMEOS (The Music Entrepreneur Operating System) is a musician-focused business management suite included within the GigConnect™ platform. TMEOS provides tools to help working musicians run their careers professionally, including but not limited to:

• Venue lead discovery via an interactive map powered by Google Places
• CRM and lead management for booking outreach
• AI-powered venue pitch email generation
• Gig calendar and scheduling
• Income, expense, and financial tracking
• Professional invoice generation and payment tracking
• Residency and recurring booking management
• Goal and milestone tracking
• Career analytics and reporting

We are not a party to any performance agreements, payments, giveaways, or offline interactions between users.

1a. TMEOS - Specific Terms

By using TMEOS features, you acknowledge and agree that:

• Venue data is sourced from Google Places API. We do not guarantee the accuracy, completeness, or currency of venue listings, contact information, or operating hours. Always verify independently before reaching out.
• AI-generated outreach emails are provided as a starting point and may require editing. GigConnect™ and TMEOS are not responsible for the outcome of any outreach, booking negotiation, or business relationship initiated using platform-generated content.
• Financial tracking and invoicing tools are provided for organizational purposes only. TMEOS is not an accounting service and does not provide tax, legal, or financial advice. You are solely responsible for your own tax obligations and financial reporting.
• Invoice payments processed through TMEOS are subject to Stripe's terms and GigConnect™ processing fees. We are not responsible for non-payment by venues or other parties.
• Venue search caching: Search results may be stored and served from cache for up to 14 days to improve performance. Results may not reflect real-time changes to venue status.
• TMEOS is a tool to support your career — not a guarantee of income, bookings, or business success. Results depend entirely on the user's own efforts, market conditions, and external factors beyond our control.

2. Eligibility

To use GigConnect:

• You must be at least 13 years old
• You must provide accurate information
• You must not impersonate another person or business
• You must comply with all applicable laws in your region

3. Core Platform Disclaimer

GigConnect™ acts solely as a software platform. We do not:

• manage, hire, or vet musicians
• manage, hire, or vet venues
• guarantee attendance, audience size, or financial outcomes
• guarantee accuracy of event listings
• guarantee giveaway fulfillment (venues run their own giveaways)
• mediate disputes between artists, venues, or fans
• oversee safety at any venue or event

All content posted on the platform is user-generated.

4. Subscription Terms

Paid features automatically renew until cancelled.

By subscribing, you agree that:

• Your payment method will be charged automatically
• You may cancel at any time inside the app
• No refunds are provided for partial periods
• Trials automatically convert to paid plans unless cancelled before renewal
• Prices may change with notice

5. Location Tracking & Geofencing

GigConnect™ uses optional location data to:

• verify fan check-ins
• track dwell time
• determine eligibility for venue giveaways
• prevent fraud or false entries

By enabling location services, you consent to this use.

You may disable location access anytime, but certain features and giveaways will not function.

6. Giveaways

Giveaways are created, funded, and fulfilled by venues, not GigConnect.

GigConnect™ provides only:

• tracking tools
• entry management
• winner selection software (if the venue chooses to use it)

Venues are solely responsible for giveaway delivery, communication with winners, and prize redemption.

7. Tips, Invoices, and Payments

Tips and payments processed through GigConnect:

• are sent directly to artists via Stripe
• include standard Stripe fees + GigConnect processing fees
• are not refundable once processed
• are not the responsibility of GigConnect in case of disputes

GigConnect™ does not collect or store credit card numbers.

8. User Conduct

You agree not to:

• abuse, harass, or threaten other users
• post harmful or illegal content
• interfere with events or misuse QR codes
• attempt to manipulate geofencing or dwell time
• attempt to reverse-engineer or damage the platform

9. Safety

GigConnect™ does not control or supervise real-world events. You attend all venues and performances at your own risk.

10. Limitation of Liability

GigConnect™ is not liable for:

• injuries, incidents, or damages at events or venues
• missed giveaways or unfulfilled prizes
• disputes between users
• lost profits or opportunities
• incorrect event information
• technical issues, downtime, or data loss

To the maximum extent permitted by law, GigConnect™ disclaims all warranties.

11. Account Termination

We may suspend or terminate accounts for:

• policy violations
• fraud
• abusive behaviour
• attempts to manipulate features or giveaways
• inappropriate or unsafe conduct

12. Changes to Terms

We may update these Terms at any time. Continued use of GigConnect™ constitutes acceptance.
